II. GENERAL TERMS AND CONDITIONS OF USE

Purpose of the Terms: The Website

The purpose of these General Terms and Conditions of Use (hereinafter, the “Terms”) is to regulate access to and use of the Website. For the purposes of these Terms, the Website shall be understood as: the external appearance of the screen interfaces, both static and dynamic, including the navigation tree; as well as all elements integrated into the screen interfaces and navigation tree (hereinafter, the “Content”), and any online services or resources that may be offered to Users (hereinafter, the “Services”).

IES Medical reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and of the Content and Services incorporated therein. The User acknowledges and accepts that IES Medical may interrupt, deactivate and/or cancel any of these elements or access to them at any time.

Access to the Website is free for the User and, in general, does not require any consideration for browsing, except for the cost of the connection through the telecommunications network supplied by the User’s access provider.

The use of certain Content or Services on the Website may require prior subscription or User registration.

The User

Access, browsing and use of the Website confer the status of User, and imply full acceptance of all the Terms set forth herein from the moment the User begins browsing, without prejudice to any applicable mandatory legal regulations. The IES Medical Website provides a wide range of information, services, and data. The User assumes responsibility for appropriate use of the Website. This responsibility includes:

• Using the information, Content and/or Services and data offered by IES Medical in accordance with these Terms, the law, morality and public order, and refraining from actions that may infringe the rights of third parties or the proper functioning of the Website.
• Ensuring the truthfulness and legality of any information provided by the User in forms supplied by IES Medical for access to certain Services or Content. The User must notify IES Medical immediately of any event that may lead to misuse of the information entered in such forms, including but not limited to theft, loss, or unauthorised access to identifiers and/or passwords, so that they may be cancelled immediately.

Access to this Website does not imply the establishment of any commercial relationship between IES Medical and the User.

The User declares to be of legal age and to have the legal capacity to be bound by these Terms. Therefore, this Website is not intended for minors. IES Medical declines any responsibility arising from failure to comply with this requirement.

Nor does IES Medical guarantee that the content or software accessible through the Website is free of errors or will not cause damage to the User’s computer system (software or hardware). Under no circumstances shall IES Medical be liable for any loss, damage or harm of any kind arising from access to, browsing of, or use of the Website, including but not limited to damage to computer systems or damage caused by viruses.

IES Medical shall not be liable for damage caused to Users due to improper use of the Website. In particular, it shall not be liable in any way for failures, interruptions, absence or defects in telecommunications.

VI. LEGAL ACTIONS, APPLICABLE LAW AND JURISDICTION

IES Medical reserves the right to initiate civil or criminal proceedings as it deems appropriate for misuse of the Website or its Content, or for breach of these Terms.

The relationship between the User and IES Medical shall be governed by the legislation in force in Spain. Any dispute regarding the interpretation and/or application of these Terms shall be submitted to the jurisdiction of the courts and tribunals corresponding according to law.
